This policy explains how EFRESH SOLUTIONS (ABN 34 133 266 950), trading as eFresh, manages personal information through our website, software, apps and related services.

1. About this policy

We respect your privacy and are committed to handling personal information responsibly. This policy describes the kinds of information we may collect, why we collect it, how it may be used or disclosed, and the choices available to you.

Where the Privacy Act 1988 (Cth) and Australian Privacy Principles apply to us, we will handle personal information consistently with those requirements. Some eFresh customers may also have their own privacy obligations when they enter information about their customers, suppliers, staff or other contacts into the platform.

2. Information we collect

The information we collect depends on how you interact with eFresh. It may include:

  • Identity and contact details, such as your name, business name, job title, telephone number and email address.
  • Account and team details, including login identifiers, permissions, user roles and account preferences.
  • Business and operational information, such as products, pricing, orders, suppliers, customers, purchase orders, inventory, delivery information, invoices and account records entered into or generated through eFresh.
  • Communications, including demo requests, emails, support enquiries, feedback, chat messages and notes.
  • Voice or audio information when you choose to use a voice-enabled feature and grant the required device permissions. Depending on the feature, audio may be converted into text to process a request.
  • Billing and transaction information, such as subscription status, invoice information and payment confirmations. Payment card details may be collected directly by a payment provider rather than stored by us.
  • Technical and usage information, such as IP address, browser and device type, operating system, log data, pages or features used, timestamps and diagnostic information.

Please do not provide sensitive information unless it is reasonably necessary for a specific eFresh feature and we have asked you to provide it.

3. How we collect information

We may collect information directly from you when you visit our website, request a demo, create an account, communicate with us or use eFresh. We may also receive information:

  • from your employer or another organisation that has authorised your access;
  • from customers, suppliers or other users who interact with your business through eFresh;
  • from systems you choose to connect, such as POS, accounting, payment, messaging, ecommerce or supplier systems; and
  • automatically through logs, cookies and similar technologies.

4. How we use information

We may use personal information to:

  • provide, operate, secure and support eFresh;
  • create and administer accounts, permissions and subscriptions;
  • process orders, communications and operational workflows requested by users;
  • connect with third-party services authorised by a customer;
  • respond to enquiries, arrange demonstrations and provide customer support;
  • monitor performance, diagnose problems and improve the platform;
  • send service messages and, where permitted, relevant product or marketing communications;
  • prevent fraud, misuse, security incidents and unlawful activity; and
  • meet legal, regulatory, accounting and contractual obligations.

You can unsubscribe from marketing emails using the link in the message or by contacting us. We may still send essential account or service communications.

5. AI and automated features

eFresh may use artificial intelligence and automated tools to interpret ordering requests, match products, prepare suggested actions, assist with workflows and provide insights. These features may process the information submitted by users and relevant business data available within an authorised account.

AI-generated outputs can be incomplete or incorrect. Customers should configure appropriate permissions and review important outputs before relying on them for pricing, purchasing, payments, inventory, delivery or other business decisions.

If we introduce automated processing that uses personal information to make decisions which could reasonably be expected to significantly affect an individual’s rights or interests, we will provide any additional disclosure required by applicable law.

6. When we share information

We may disclose information to:

  • people within your organisation according to the permissions configured for the account;
  • customers, suppliers, delivery partners or other parties when necessary to complete a workflow you or your organisation has requested;
  • service providers supporting hosting, cloud infrastructure, communications, AI processing, analytics, security, payments, customer support and professional services;
  • connected third-party platforms when an authorised user enables an integration;
  • professional advisers, insurers, regulators, courts or law-enforcement bodies where reasonably necessary or legally required; and
  • a purchaser or successor in connection with a genuine business sale, merger or restructure, subject to appropriate confidentiality protections.

We do not sell personal information as a standalone product.

7. Overseas processing

Some technology and service providers we use may store or process information outside Australia. The locations can vary depending on the services selected by us or by an eFresh customer and may include the United States and other countries where those providers operate.

Where Australian privacy law applies, we take reasonable steps appropriate to the circumstances when engaging overseas providers. You can contact us for further information about the providers relevant to your use of eFresh.

8. Security and retention

We use reasonable technical and organisational safeguards designed to protect information against misuse, interference, loss and unauthorised access, modification or disclosure. No online service or storage system can be guaranteed to be completely secure.

We retain information for as long as reasonably necessary to provide the services, maintain business and legal records, resolve disputes, enforce agreements and meet applicable obligations. When information is no longer required, we take reasonable steps to delete it or de-identify it, subject to legal and technical requirements.

9. Your choices and rights

You may ask to access or correct personal information we hold about you. We may need to verify your identity and, in some cases, an exception permitted by law may apply.

If your eFresh access is provided through an employer or another organisation, that organisation may control the relevant account data. We may refer your request to that organisation where appropriate.

You can manage browser cookies through your browser settings. More information is available in our Cookies Policy.

10. Questions and complaints

If you have a privacy question, want to request access or correction, or wish to make a complaint, email hello@efresh.au.

Please provide enough information for us to understand and investigate your request. We will acknowledge and respond within a reasonable period. If you are not satisfied with our response, you may be entitled to contact the Office of the Australian Information Commissioner.

We may update this policy when our services or legal obligations change. The latest version will be published on this page with its updated date.
